Conservator Services for Protected Persons

 

 

A Conservator is one who is appointed by the Court to manage the estate of a protected person.  A protected person is either an adult or minor who is unable to manage their property and financial affairs for reasons such as mental illness, mental deficiency, physical illness or disability, chronic use of trugs, chronic intoxication or confinement. 

The goal of the Conservator is to protect and manage the assets and income of the protected person.  The Court Order appointing the Conservator may limit the scope of the Conservator's powers, and may also provide some financial discretion to the protected person.  The Conservator, shortly after appointment, prepares an inventory of the protected person's assets and liabilities and prepares a financial plan including projected income and expenditures.  These are submitted to the Court for approval. The Conservator then manages the protected person's estate according to the plan, making adjustments as circumstances change. Annually, the Conservator must report to the Court (and specified interested parties) on the financial situation of the estate, including all transactions that were made.  The Conservator will also arrange for tax returns to be prepared if required.

While many conservatorships are implemented by family members, sometimes there is not a family member able or willing to be the Conservator, or there is insufficient trust among family members for one of them to be named as Conservator.  In other situations, there are no family members available, and a hospital or other organization caring for the individual requests a conservatorship.  We can assist by being named or appointed as Conservator in these situations.

Sometimes the family may not wish for the Court to be involved, but would like a third party to act as a fiduciary for a family member who needs help.  We can assist in these situations as well.
